E-Cigarettes: The latest Legislation

290 x 141 ecigNew laws have come into force from 1st October 2015 which will make it illegal to sell e-cigarettes to anyone under the age of 18 and make the proxy purchase of tobacco and e-cigarettes illegal.

The penalties for retailers who sell e-cigarettes to under 18s will mirror those currently in place for the underage sale of tobacco products. The fixed penalty fine for the proxy purchase of tobacco and e-cigarettes will be £90 and the fine only applies to the person who purchases or attempts to purchase tobacco or nicotine products (such as e-cigarettes) on behalf of a person under the age of 18.

Please note that there is an exemption for e-cigarettes which are licensed as a medicine. E-cigarettes licensed as medicines by the Medicines and Healthcare products Regulatory Agency (MHRA) are allowed to be sold to persons under the age of 18.

These new pieces of legislation form part of the Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015 and the Proxy Purchasing of Tobacco, Nicotine Products, etc. (Fixed Penalty Amount) Regulations 2015.
